Terms of Service

These Terms of Service are an agreement between you and Outkite. By creating an account or using Outkite, you agree to these terms. If you use Outkite for a studio or organization, you confirm that you have authority to accept these terms on its behalf.

Outkite is a software service for creative studios. It provides tools for managing leads, proposals, contracts, shoots, invoices, payments and client communication. We may add, change or remove features as the service develops.

We aim to keep Outkite available, but maintenance, security events, provider outages and circumstances outside our control may cause interruptions.

• You must provide accurate account information and keep it up to date.
• You are responsible for your login credentials and for activity under your account.
• You must promptly notify us of unauthorized access or a security concern.
• Organization owners and administrators control team access and are responsible for inviting the right people.
• You must be at least 18 years old and legally able to enter this agreement.

You retain ownership of the content you upload or create in Outkite. You grant us a limited license to host, process, display, back up and transmit that content only as needed to provide, secure and improve the service.

You are responsible for your content and for having the rights and permissions needed to use it. Do not upload content that is unlawful, infringes someone else's rights or contains sensitive information you are not permitted to process.

You may not use Outkite to:

• break the law, violate a contract or infringe another person's rights;
• probe, scan, disrupt or attempt to gain unauthorized access to the service;
• upload malware, harmful code or content designed to deceive or harass;
• scrape, resell or reverse engineer the service except where applicable law allows it;
• send spam or use client communication features for abusive or unlawful campaigns.

Paid plans renew at the interval shown at checkout until canceled. You authorize our payment processor to charge the selected payment method for the plan, applicable taxes and any approved changes.

You can cancel from your account settings or by contacting us. Cancellation normally takes effect at the end of the current paid period, and you keep access until then. See our Refund Policy for refund terms.

We may change pricing with reasonable notice. If a payment fails, we may restrict paid features after giving you an opportunity to update your payment method.

Outkite, including its software, branding, interface and underlying technology, is owned by Outkite or its licensors. These terms give you a limited, non-exclusive, non-transferable right to use the service while your account is in good standing. No ownership rights are transferred to you.

If you send feedback, you allow us to use it without restriction or compensation, while you retain ownership of any underlying content.

Our Privacy Policy explains how we collect and use information. Our Cookie Policy explains the cookies and similar technologies used by Outkite.

Outkite is provided on an “as available” basis. To the maximum extent allowed by law, we disclaim implied warranties and do not guarantee that the service will be uninterrupted, error-free or suitable for every business need.

To the maximum extent permitted by law, Outkite will not be liable for indirect, incidental, special or consequential loss. Our total liability for claims relating to the service will not exceed the amount you paid us for the service during the three months before the event giving rise to the claim. Nothing in these terms limits liability that cannot legally be limited.

You may stop using Outkite and close your account at any time. We may suspend or terminate access if you materially breach these terms, create a security or legal risk, or fail to pay amounts due. Where practical, we will give notice and an opportunity to resolve the issue.

After termination, your right to use the service ends. We may keep limited information where required by law or needed for legitimate business records. Contact us promptly if you need help exporting your content.

We may update these terms as Outkite changes. We will update the date above and provide notice of material changes when required. Continued use after the effective date means you accept the updated terms.
